Terms of Use

These Terms of Use (the "Terms") govern your use of the software "Sumipa" (the "Software") provided by the developer tezuka (the "Developer"). By installing, downloading or using the Software, you (the "User") are deemed to have agreed to these Terms.

1. Grant of license

  1. The Developer grants the User a non-exclusive, non-transferable right to use the Software in accordance with these Terms.
  2. For each license purchased, the User may install and use the Software on Macs that the User owns or controls.

2. Prohibited conduct

The User must not:

  1. copy, modify, adapt, reverse-engineer, decompile or disassemble all or part of the Software;
  2. resell, redistribute, lend or sublicense the Software to any third party;
  3. share license keys or purchase information with any third party;
  4. extract resources embedded in the Software (icons, text, etc.) for separate use;
  5. use the Software for any purpose that violates law or public order and morals.

3. Intellectual property

The Software and all related intellectual property rights belong to the Developer or to the rights holders who have licensed them to the Developer. Nothing in these Terms constitutes a transfer of those rights.

4. Handling of user data

  1. The Software performs no internet communication and never transmits your personal information or PDF content to any external party. The only network use is local-network communication with scanners on your LAN when you use the scan feature.
  2. Data the Software stores on your Mac is handled in accordance with the separate Privacy Policy.

5. No warranty

  1. The Software is provided "as is." The Developer makes no warranties, express or implied, including as to fitness for a particular purpose, merchantability, non-infringement of third-party rights, or freedom from errors or bugs.
  2. The User shall take necessary measures at their own responsibility, such as backing up PDFs before editing them.

6. Limitation of liability

The Developer shall not be liable for any direct, indirect, special, incidental or consequential damages (including data loss, lost profits or business interruption) arising from the use of, or inability to use, the Software, except in cases of the Developer's willful misconduct or gross negligence.

7. Support

  1. The Developer provides support for the Software through the support contact listed on the distribution page, within a scope determined by the Developer.
  2. The content and hours of support may change without notice.

8. Updates

  1. The Developer may provide updates for bug fixes, improvements and security from time to time.
  2. Minor updates (where the decimal portion of the version number changes, e.g. v1.0 → v1.1) are provided free of charge.
  3. Major updates (where the integer portion changes, e.g. v1.x → v2.0) may be offered separately for a fee.

9. Refunds

  1. As a rule, no refunds are given after purchase of the Software.
  2. For purchases made through the App Store, refunds follow Apple's refund policy.
  3. For purchases made through direct sales, if the Software cannot be used for technical reasons, please contact support within 14 days of purchase. We will respond according to the situation.

10. Changes to these Terms

The Developer may change these Terms when deemed necessary. The amended Terms take effect when posted on the distribution page.

11. Governing law and jurisdiction

These Terms are governed by the laws of Japan. Any dispute relating to these Terms or the Software shall be subject to the exclusive jurisdiction of the court having jurisdiction over the Developer's address as the court of first instance.
